Doing violence and evil always indirectly or directly leads to making someone else suffer. Such is the dialogical structure of evil and it seems to be the dialogical structure of elder abuse as well. There is a perturbing sameness between definitions of evil and definitions of elder abuse. It is hard at times to see how or if there is any line of demarcation between the subjects. Two modern‐day philosophers, Paul Ricoeur and Simone Weil have delved particularly into the concept (...) of evil. The symbolism Ricoeur analyses in depth is that of defilement, sin, and guilt and the concept of the servile will. Integral in Weil's description of evil are the concepts of suffering and the special situation of extreme suffering, termed affliction. Grounded in the writings of Ricoeur and Weil, this paper is a series of reflections on the intersection of evil and elder abuse as exemplified in the narrative of an abused older woman. This woman provided around the clock care at home for her husband who had vascular dementia. She was also abused by her husband. This was witnessed by both family and others but no one intervened. In her narrative there were indications of defilement, sin, guilt, and true affliction as a servile will. This paper illuminates the evil of elder abuse that is harm and suffering, and the challenge of untangling issues of blame, free will, responsibility, and self‐determinism. When engaging with abused, older persons it can be worthwhile for nurses to enter the encounter with non‐judgemental compassion founded on the human to human connection and recognition of our mutual fallibility and potential for evil that is part of our human fragility. The principles of biomedical ethics – autonomy, non-maleficence, beneficence, and justice – are of paradigmatic importance for framing ethical problems in medicine and for teaching ethics to medical students and professionals. In order to underline this significance, Tom L. Beauchamp and James F. Childress base the principles in the common morality, i.e. they claim that the principles represent basic moral values shared by all persons committed to morality and are thus grounded in human moral psychology. We empirically investigated the relationship (...) of the principles to other moral and non-moral values that provide orientations in medicine. The Principle of Non-Contradiction is found and christened as “the firmest principle” by Aristotle. Since then, almost no objection has been raised against this principle and its firmness, until Łukasiewicz. By reflecting on the possibility of the emergence of new systems of logic with reference to the developments in non-Eucledian geometry, Łukasiewicz stated that the reconsideration of the principles of logic may lead to new systems. With the guidance of this idea, in his revolutionary work “On the Principle of Contradiction (...) in Aristotle” Łukasiewicz approaches Aristotle’s account on the Principle of Non-Contradiction and analyzes it thoroughly. Starting with the identification and the comparison of three distinct definitions of the Principle of Non-Contradiction in Metaphysics, the Polish logician criticizes Aristotle’s arguments regarding the unprovability and the firmness of the principle. Even though Aristotle defended that the principle cannot be proved by direct proof but can be proved by indirect ones, i.e. elenchus, Łukasiewicz realizes that Aristotle’s aforementioned distinction is actually built on sand, since the Stagirate had stated in Prior Analytics that these two types of proof can be used interchangeably. This statement means that there is no err in using direct proofs instead of elenchtic ones and thus it appears that if the principle can be proved by elenchus, it can be proved by direct proof as well. In other words, Aristotle runs into a contradiction by trying to prove the principle that cannot be proved. Having found that there lies a contradiction in the very foundations of the Principle of Non-Contradiction regarding its unprovability, he continues with scrutinizing Aristotle’s elenchtic proofs in Metaphysics. With the discovery of fallacies appealed by Aristotle in those proofs, Łukasiewicz is ready for raising his objection to the firmness of the Principle of Non-Contradiction. Starting with stating how contradictions were defined before and by Aristotle, how the Stagirate formulated the Principle of Non-Contradiction, our study aims to examine Łukasiewicz’s objection and summarize his arguments against the Principle of Non-Contradiction. Et ce n’est pas seulement (...) que le processus de la métamorphose se réalise par le passage à travers les eaux, stagnantes ou courantes, car il peut se produire qu’un mégalithe avec cupule fréquenté par les garous serve dans un rite païen de confirmation du baptême. Sans compter d’autres êtres fantastiques proprement aquatiques qui se révèlent être des loups-garous déclarés. En remettant en phase la relation de fertilité impliquant la lune et les eaux par rapport à ce cadre rituel, il devient clair que l’on peut dorénavant placer sur le même pied leurs médiations dans cette métamorphose matricielle qu’est la lycanthropie. Reconsidering core narratives of lycanthropic rites of passage, from ancient Greece to contemporaneous French folklore—the main field of our thesis in anthropology of religion —via Baltic reports giving a first view of Renaissance in Livonia, it appears that there is a strong aquatic component which has been underestimated in werewolves, compared to the emphasis put upon moon influence. Not only metamorphosis occurs when crossing ponds or rivers, but even cup marks on megaliths can contribute to a pagan confirmation rite just after christening. Not to speak of other fantastic aquatic beings which are recognized as true werewolves. Resetting the fertility relationship between waters and the moon into this ritual framework proved to be the key for understanding their mediations on the same footing in this metamorphosis matrix: lycanthropy. Disorders of Consciousness (DoCs) raise difficult and complex questions about the value of life for persons with impaired consciousness, the rights of persons unable to make medical decisions, and our social, medical, and ethical obligations to patients whose personhood has frequently been challenged and neglected. Recent neuroscientific discoveries have led to enhanced understanding of the heterogeneity of these disorders, and focused renewed attention on the medical and ethical problem of misdiagnosis. -/- This book examines the entanglement of epistemic and ethical (...) uncertainty in DoCs and other medical contexts, and how they interact to create both epistemic and ethical risks. Philosopher and bioethicist L. Syd M Johnson pulls together multiple threads in this work: the ontological mysteries of consciousness, medical uncertainty about unconsciousness, ableist bias, withdrawal of treatment in neurointensive care, and the rarely questioned view that consciousness is essential to personhood and moral status. Johnson challenges longstanding bioethical dogmas about DoC patients, and argues for an ethics of uncertainty for contexts where there is a need for decisive action in the presence of unavoidable uncertainty. The ethics of uncertainty refocuses ethical inquiry concerning persons with DoCs, placing less emphasis on their contested personhood, and more on inductive risk and uncertainty, on respect for autonomy, and especially on epistemic justice. With applications to various decisional contexts where uncertainty and ethical risk interact, this ethical approach enables surrogate decision makers facing fraught and risky choices to fulfill their obligations as moral and epistemic agents. Moral Case Deliberations are reflective dialogues with a group of participants on their own moral dilemmas. Although MCD is successful as clinical ethics support, it also has limitations. 1. Lessons learned from individual MCDs are not shared in order to be used in other contexts 2. Moral learning stays limited to the participants of the MCD; 3. MCD requires quite some organisational effort, 4. MCD deals with one individual concrete case. It does not address other, similar cases. These limitations warrant (...) research into complementary ways of providing CES to healthcare professionals. Our research objective was therefore to develop a low threshold CES tool based on a series of MCDs on autonomy in long-term care. We used a qualitative research design in which we analyzed the process and content of a series of MCDs, combined with reflections on the theoretical background of MCD. In total 28 MCDs were analyzed by means of a thematic content analysis. In various rounds of development, the results of the analysis were combined with theoretical reflections on CES. Consequently, the tool was evaluated in three focus groups and adjusted. The CES tool, called ‘moral compass’, guides the users through a series of six subsequent questions in order to methodically reflect on their concrete moral dilemma, in the form of a booklet of 23 pages. It combines a methodical element that encourages and structures a reflection process with a substantive element, including norms, values, options, strategies, and insights regarding dealing with client autonomy. By using data from a series of MCDs, combined with theoretical reflections on MCD, ethics support and moral learning, we developed a thematic, low-threshold CES tool that supports healthcare professionals in daily practice in dealing with moral questions regarding client autonomy. It integrates examples and insights from earlier MCDs on the same topic. The moral compass is not a replacement of, but can be used complementary to MCD. The feasibility and impact of the moral compass need to be investigated in an evaluative follow-up study. The methodology presented in this paper may be used to develop moral compasses on different topics in various healthcare organizations. (shrink)

We have arrived at an inflection point, a moment in history when the sentience, conscious- ness, intelligence, agency, and even the moral agency of many nonhuman animals can no longer be questioned without ignoring centuries of accumulated scientific knowledge. Nowhere is this more true than in our understanding of nonhuman primates (NHPs). A neu- roethics committed to probing the ethical implications of brain research must be able to respond to and anticipate the challenges ahead as brain projects globally prepare to (...) increase the use of NHPs in research. This requires adopting a less anthropocentric focus that includes nonhuman animals within its scope. But the Neuroethics Roadmap represents a missed opportunity to critically examine the future direction of research with NHPs in an ethically-responsive neuroscience. (shrink)

The Emerging Issues Task Force (Kellmeyer et al. 2019) identifies several important trends and concerns that neuroethics will encounter and grapple with in the com- ing decades. Among these are ethical issues related to the creation of new nonhuman entities, such as artificial intelligence systems, and human origin entities like brain organoids. The task force briefly mentions animal minds and animal rights, to which neuroethics to date has paid scant attention (Buller et al. 2014). As neuroscientific knowledge and knowledge from (...) other fields, including, to name a few, comparative psychology, primatology, ethology, biology, genetics, and medical sociology, accu- mulate, ethical concerns about the use of nonhuman ani- mals in research, agriculture, entertainment, and elsewhere will grow more visible and more urgent. Turning neuroethical attention toward nonhuman ani- mals also promises to illuminate issues related to specific human populations that are within the purview of a more expansive, forward-looking neuroethics. The interconnections, common interests, and other linkages between the Jewish and Islamic traditions have long been a matter of interest to academics. Today the need to understand these relationships, and to emphasize commonalities rather than conflicts, is of the greatest public interest. The present volume of studies, likely the first such collection in the scholarly literature, explores the full range of interconnections between Jews and Muslims in all fields (intellectual history, religion, philosophy, social history, etc.) and in all periods, from (...) the Middle Ages till today. Hans Kelsen est, sans conteste, le juriste le plus important de ce siècle. Il n'y a pas une seule question de théorie juridique qu'on puisse traiter aujourd'hui sans examiner d'abord l'analyse qu'il en fait, mais son œuvre ne concerne pas seulement le droit et la philosophie du droit ; elle touche aussi la philosophie politique, l'épistémologie, l'éthique ou la logique. Sa théorie du droit représente, à côté du réalisme, l'une des deux branches du juspositivisme moderne, connue sous le nom de (...) normativisme et que lui-même appelait " Théorie pure du droit ". Elle se donne comme une théorie scientifique qui se borne à décrire son objet, le droit positif, et qui donc est " pure " de tout jugement de valeur. La pureté ne concerne toutefois que la méthodologie. Le droit, lui, n'est nullement pur, car il exprime des choix moraux et politiques. La doctrine kelsenienne pure apparaît ainsi doublement politique : d'une part, elle se donne pour tâche de mettre en évidence la fonction idéologique du droit ; d'autre part, dans la mesure où elle analyse les dispositifs juridiques comme des moyens au service de certaines fins, elle peut servir de fondement à une véritable technologie juridique. C'est cette technologie que Kelsen prétendait appliquer à la politique et qui fonde aussi bien son travail de constituant - il est le père de la Constitution autrichienne et de la première Cour constitutionnelle - que ses écrits sur la démocratie. Chris Tucker's paper on the hiddenness argument seeks to turn aside a way of defending the latter which he calls the value argument. But the value argument can withstand Tucker's criticisms. In any case, an alternative argument capable of doing the same job is suggested by his own emphasis on free will.

This article is about Gilles Deleuze's book Le Pli. Leibniz et le Baroque from 1988. It shows how Deleuze's notion of folding captures some basic intuitions in Leibniz and how they relate to each other. To this purpose, I propose five figures, all referring to the same basic fold, all illustrating how the consideration of such figures allows developing central elements of Leibniz's monadology. These figures can help, I hope, alleviate some of the fundamental difficulties in understanding Deleuze's approach to (...) the Monadology from the non-Deleuzian perspective of contemporary Leibniz scholarship and give a sense of the synthetic, explanatory force that Deleuze's notion of folding has in relation to Leibniz's monadological metaphysics. There is ongoing ethical and legal debate about withdrawing life sup- port for patients with disorders of consciousness (DOCs). Frequently fu- eling the debate are implicit assumptions about the value of life in a state of impaired consciousness, and persistent uncertainty about the quality of life (QoL) of these persons. Yet there are no validated methods for assessing QoL in this population, and a significant obstacle to doing so is their inability to communicate. Recent neuroscientific discoveries might circumvent that problem (...) and help shed light on QoL in DOCs. There is an ethical imperative to prioritize QoL research in this patient population, to provide evidence to inform treatment, research, and end of life decisions. A minimalist and pragmatic model of QoL is proposed, targeting positive and negative affect as domains for which there is po- tential to reach across the communication gap, and restore to these voiceless persons some measure of control. ABSTRACT‘Green’ concerns about nature, the environment or the climate have traditionally been juxtaposed with concerns about economic growth or job creation. Recently, however, a new type of conflict has appeared, in which different green concerns, for instance regarding mitigation of climate change and protection of landscape qualities, seem to collide. These environmental conflicts have so far received little scholarly attention. This article addresses the issue by a study of national and in particular local news media discussion on the construction of (...) wind turbines in Denmark, bringing together research traditions from environmental communication, discourse analysis, and place studies. Analytically, the study employs the notion of topos as the key meaning unit, referring to the premises upon which an argument is based. The sphere of manifestation of philosophy is thinking. Thinking itself appears and is reflected in different forms, which contributes to a different perception of philosophy. The study and teaching of philosophy as a science is its main direction, an important condition for which is the disclosure of truth. Throughout history, this process manifested itself first as a manifestation of philosophy in theology, and then as its reflection in poetry. "Philosophy of Azerbaijani Studies" by Heydar Aliyev is a discourse aimed at (...) the formation and development of society. In other words, the national leader directed philosophy to its practical implementation in statehood and human life. According to our conclusions, Heydar Aliyev's "philosophy of Azerbaijani studies" was not only an intention, but also a means. The basis of this philosophy was laid in advance, but its full formation took place during the period of independence of Azerbaijan. The main tasks in this situation were self-consciousness, self-return and self-expression. The basis of the essence of the “philosophy of Azerbaijani studies” is, regardless of the affiliation and dissent of the people, to preserve and maintain the main traditions and cultural heritage. It is precisely such efforts that ensure the ideological security of society and actually prevent the creation of problems and barriers that block its development. Heydar Aliyev combined various understandings of globalization, multiculturalism and cosmopolitanism in a single understanding and reunited them in a common philosophy, which was called the “philosophy of Azerbaijani studies”. In his reports and speeches, explaining the essence of the "philosophy of Azerbaijani studies", he referred to a single whole of different cultures and noted the importance of solitude. The strategic plan and the main elements of the “philosophy of Azerbaijani studies” are the development of the Azerbaijani language, religion and culture, as well as the preservation of national and spiritual values and traditions. In the article, all these concepts are explained with illustrative examples. In integrity, Heydar Aliyev's "philosophy of Azerbaijani studies" serves to unite, preserve, develop the tradition of independence and create a legal-social state. (shrink)

Ainsi éclairée par cette intersection entre sa propre démarche et celles des trois auteurs convoqués dans cet essai, la pensée heideggérienne permettra alors de comprendre, de manière renouvelée et novatrice, le sens ontologique secret de l'existence humaine en tant qu'elle a affaire avec ce que Lacan a nommé la jouissance comme ouverture à la "Chose". Jerry L. Walls argues that the doctrine of heaven is ripe for serious reconsideration. He contends not only that the orthodox view of heaven can be defended from objections commonly raised against it, but also that heaven is a powerful resource for addressing persistent philosophical problems, not the least of which concern the ground of morality and the meaning of life. Walls shows how heaven is integrally related to central Christian doctrines, particularly those related to salvation, and tackles the difficult (...) problem of why faith in Christ is necessary to save us from our sins. In addition, heaven is shown to illumine thorny problems of personal identity and to be an essential component of a satisfactory theodicy. Walls goes on to examine data from near-death experiences from the standpoint of some important recent work in epistemology and argues that they offer positive evidence for heaven. He concludes that we profoundly need to recover the hope of heaven in order to recover our very humanity. (shrink)

SETTING: Previous health policies in South Africa neglected the teaching of ethics and human rights to health professionals. In April 1995, a pilot course was run at the University of Cape Town in which the ethical dimensions of human rights issues in South Africa were explored. OBJECTIVES: To compare knowledge and attitudes of participating students with a group of control students. DESIGN: Retrospective cohort study. SUBJECTS: Seventeen fourth-year medical students who participated in the course and 13 control students from the (...) same class, matched for gender. INTERVENTIONS: Students participated in a one-week module on ethics and human rights. Five months after the course had been run, students completed a semi-structured questionnaire exploring their knowledge and attitudes with regards to ethics and human rights issues. MAIN OUTCOME MEASURES: Knowledge scores, attitude scores and various individual indicators of attitude. RESULTS: Clear benefits for overall knowledge score, for four out of five individual knowledge questions and for one of the attitude questions, were demonstrated. Participating students also appeared to be more convinced of the need for teaching on the ethical dimensions of human rights at postgraduate level and that such teaching should also be integrated in the curriculum. The low response rate amongst controls may have selected students who were more socially conscious, thereby leading to an underestimate of the true impact of the course. CONCLUSION: The evaluation indicates clear benefits of the course for undergraduate students, and supports arguments for the inclusion of such courses in the training of health professionals. This is particularly important given the challenges posed by the Truth and Reconciliation Commission to the health professions to address past complicity in human rights abuses through reorientation of medical training in South Africa. The phenomenon whereby severely disabled persons self-report a higher than expected level of subjective well-being is called the “disability paradox.” One explanation for the paradox among brain injury survivors is “response shift,” an adjustment of one’s values, expectations, and perspective in the aftermath of a life-altering, disabling injury. The high level of subjective well-being appears paradoxical when viewed from the perspective of the non-disabled, who presume that those with severe disabilities experience a quality of life so poor that it might (...) make their lives not worth living. This presumption has profound consequences, for it may inform end-of-life choices made in advance directives, or influence decisions made by surrogates on behalf of persons who are unable to direct their own medical treatment. -/- Peterson et al propose a cautious, well-considered plan to use fMRI-based brain-computer interfaces to assess the decision making capacity of covertly aware, behaviorally non-responsive individuals who retain high levels of preserved cognition. Their plan, if it succeeds, could eventually restore autonomy and empower some severely disabled persons, allowing them to participate in clinical decision making. Peterson et al discuss possible in-principle objections to their proposal, among them the “argument from psychological health,” and the “changing sets of values” objection. These objections both presume that deviations from a pre-injury norm could indicate diminished decision making capacity. This presumption threatens the autonomy of the patient who is capable of making decisions, but whose post-injury decisions appear to diverge from pre-injury preferences or values. In light of the potential for response shift, and the disability paradox, it should not be inferred that changes in values or preferences are unreflective of the true current preferences of a brain-injured person, nor are they conclusive evidence of diminished capacity. Presuming diminished capacity on the basis of unexpected or unconventional preferences has, in the past, been used to disempower patients whose autonomy and capacity would not have been doubted had they made choices that accorded with the expectations or values of others. We must be cautious, and vigilant, to prevent similarly diminishing the autonomy of covertly aware, behaviorally non-responsive individuals on the basis of empirically and ethically questionable inferences about their decision making capacity. The Hellenistic Schools of Epicureanism, Cynicism and Stoicism are considered to constitute the first, albeit modest, wave of feminism. But the question: ‘Were the Stoics Feminists?’ has attracted little attention due to a paucity of available evidence. What this paper attempts is a comprehensive treatment of the subject. In particular it addresses two distinct claims that have been made about the Stoic attitude to women. The first claim challenges the view that the Stoics were thoroughgoing feminists. The second is that, (...) given the Stoic fixation on social duty, women's relegation to the domestic sphere is a consistent Stoic position. It is argued that Stoicism was fundamentally committed to the emancipation of women even though many of its proponents were inconsistent feminists. This inconsistency put them at odds with Stoicism's avowed mission to provide a critique of social convention and to promote the ideals of the cosmopolis. (shrink)

Il s’agit dans cet article de dégager une certaine disposition de la philosophie russe envers la traduction comme opération fondamentale de la pensée. On considérera les cas précis des trois penseurs jouissant d’un prestige européen – Léon Chestov, Mikhaïl Bakhtine et Valery Podoroga. Cette disposition, considérée dans le geste des philosophes face à l’intraduisible, se manifesterait tout simplement par la violence, faite à l’original, de la non-hospitalité culturelle.
